AupairinBritain.com operates an internet platform for au pair applicants and potential host families. As a registered user you will have the opportunity to find either a suitable host-family, or to find an au pair girl or boy to assist your family. Unlike traditional au pair introduction agencies AupairinBritain.com does not act as an agent. AupairinBritain.com provides access to a database and allows registered users to use the data in order to contact potential au pairs or host families. Arrangements made between the parties are between them only, and are not regulated by AupairinBritain.com.

Host Family: "An individual or group sharing living accommodation on a full time basis and offering to an applicant (the au pair) free accommodation, food and an agreed amount of pocket money in exchange for assistance with childcare and/or light housework." Applicant: "An au pair, au pair plus or junior mothers help who registers with Aupairinbritain.com to find a host family willing to offer them full board and lodging and pocket money in exchange for help with childcare and/or light housework"

You and your Profile

1. By using this website and/or registering for full membership services from Aupairinbritain.com , you confirm that you are aged 18 or over and therefore able to enter in to this legally binding contract. 2. You further confirm that the information you have provided is true and accurate and that you have provided us with a valid email address when registering. You commit to updating this email address in your profile if it changes or mail forwarded to yourself will not be guaranteed and we can take no responsibility for subsequent loss of mail or any liability arising from that loss. If your email address no longer exists we reserve the right to close your account, resulting in the loss of your membership. 3. Your registration or use of the aupairinbritain.com site confirms that you agree to be bound by the following terms and conditions: 4. On registering with Aupairinbritain.com you agree to your details being displayed on the website. Your private contact details and any other details that you specify on the registration form as confidential (eg your address, telephone numbers, email address, family date of birth details) will never be displayed on the site. Your full name will only be displayed if you provide this, if you do not wish to give your surname please use an alias. 5. By posting a personal profile (content and information about you or your family) and/or any photos, complaints, comments or testimonials on AuPairinBritain.com you grant to AuPairinBritain.com a non-exclusive, royalty-free, irrevocable right in perpetuity to use in any way, adapt, publish, distribute, and display your profile information, including but not limited to written content, photos, videos, complaints, comments or reviews. You also grant AuPairinBritain.com the right to use the name that you submit with any profile, complaint, comment or testimonial, if any, in connection with such profile, complaint, comment or testimonial. 6. Aupairinbritain.com reserves the right, at its sole discretion, to cancel your registration & membership without notice and without refund, block your access to this website & remove all of your posted material if it deems this necessary & in the interests of other members. Examples which may trigger such cancellation would include, but not be limited to, attempts to:

a. Post inappropriate material of any description on this website b. Include or enter your personal contact information such as an email address, chat address, Facebook or other social networking name or personal web page address in any photo, image or text field which does not specifically request such information; c. Subvert the registration system or direct users to any other website, location or directory where your contact information may be obtained; d. Upload or post any information or advertisement that may be considered as competitive to the AupairinBritain website. e. Solicitation for services by any means, other than those offered or directly approved by AupairinBritain.com, to its registered users is strictly forbidden. And under no circumstances shall the harvesting and commercial re-use of emails be allowed; f. Share your account credentials or premium membership subscription with any other person or third party. If, despite the foregoing, you lose control of your password, you may lose substantial control over your personally identifiable information and may be subject to legally binding actions taken on your behalf; g. Upload, post, email or otherwise transmit any content that is unlawful, harmful, threatening, harassing, defamatory, obscene, vulgar, invasive of another's privacy, hateful, discriminatory or otherwise objectionable; h. Create or maintain more than one active profile at a time. Each family and candidate is allowed only one active profile in the AupairinBritain.com database at any one time; i. Upload, post, email or otherwise transmit any content that you do not have a right to transmit under any law or under contractual or fiduciary relationships (such as insider information, proprietary and confidential information learned or disclosed as part of employment relationships or under nondisclosure agreements) or any content that infringes any patent, trademark, trade secret, copyright or other proprietary rights of any party; j. Forge headers or otherwise manipulate identifiers in order to disguise the origin of any content transmitted through this site; k. Upload, post, email or otherwise transmit any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software; l. Interfere with or disrupt (or attempt to interfere with or disrupt) this site or servers or networks connected to this site, or disobey any requirements, procedures, policies or regulations of networks connected to this site; m. Exhibit expressions of abuse, use or display offensive language or imager. n. Solicit any relationship other than in relation to the provision of au pair services.

Use of the Website You are solely responsible for your own interactions with other Members. You are responsible for the accuracy of any information necessary for us to perform the Service and for your interactions with other Members. 7. Registration on Aupairinbritain.com for both families and au pairs is free. For au pairs the entire service is completely free. For families a paid membership is not required to list your family profile or search the database. Once you have registered for free, you may choose to purchase a membership to communicate with Au Pairs via email or skype for the subscription period paid for. It is at the discretion of individual members to decide if they wish to exchange phone numbers or other personal details. 8. You will not be able to contact other Members and view AuPair Documents until the Family Member has upgraded to Full Membership and we have received full payment. 9. Au pair members will not be able to contact Family Members until the Aupair Member has correctly registered his or her details free of charge. 10. Your application for membership will come into effect once the acceptance of your membership has been confirmed by AupairinBritain to you by email. 11. We reserve the right to vary these Terms & Conditions at any time. The latest terms & conditions are those displayed on our website. 12. We reserve the right to make changes to the Service as deemed necessary or desirable. The Family joining fees for membership of the Service are shown under on the Payment Page. We reserve the right to vary these prices at any time.

Payment of membership 13. Our preferred method of payment is by credit/debit card. Payment is made by a secure server, which will encrypt your transaction for your security. The payment system used is a Worldpay credit/debit card processing system. 14. All credit/debit card payments must be made in UK pounds sterling. 15. There are no refunds on membership subscriptions. Once AupairinBritain.com has received payment for a subscription term, you will be granted full access to either the Family or Applicant Contact Database, based on your selection and term. Paid memberships cannot be put on hold for use at a later time. If you suspend your profile your subscription term will still expire based on the number of consecutive calendar days from the date your most recent subscription or renewal term took effect. If you delete your account it will be permanently removed & any remaining paid membership will be terminated without any refund. AupairinBritain does not provide a pro-rata refund for unused subscription terms. Membership subscription payments are non refundable. 16. You are responsible for terminating or suspending your membership should you wish to do so by deleting or suspending your profile. Account cancellation is the sole responsibility of the account creator. 17. You agree to inform us if you find a family or an au pair on the site by following instructions provided on the site for this purpose. 18. We reserve the right to deactivate your account in the event you have not signed in to your AuPairinBritain account for over 30 days. Deactivation of your account means that your profile will not appear in the results of any database searches on AupairinBritain.com. You will be notified via your registered email address that your account has been deactivated. Should you fail to access and reactivate your account within the remaining subscription period and before the expiry date of that subscription, your subscription will still expire on that date. Membership is not automatically renewed and the site will direct a family to the membership renewal page when they next log in after their membership has expired. All fees are purely for the contact information of potential au pairs or families. This is not an employment fee and we are not an Au Pair Agency, nor are we an employment agency.

References 19. The information gathered as part of the registration process is designed to assist au pairs and families to find a potential family or au pair and then make private arrangements with them. Host families are responsible for taking up the references of their potential au pair and, for their convenience, each applicant has been required to provide at least two references and a scan of at least one document confirming their identity. 20. The system will clearly state if an au pair has not yet provided the required items of documentation to AupairinBritain. In such a case the potential host family becomes responsible for asking their potential au pair to supply these documents direct to them before deciding to accept them into their home. The potential family accepts responsibility for taking up the references before taking on their chosen au pair and also for the verification of their original identity document on arrival of the au pair in Britain or Ireland to join their family. 21. Each au pair applicant has also been asked to submit additional optional documents. If they are not available on the website, the host family is responsible for asking the au pair to provide these optional documents if they wish to have them. The au pair has confirmed as part of the registration process that all the information given is to the best of their knowledge true and correct. The au pair has also stated during the registration process that s/he has never been found guilty of any crime and that they are medically fit to work with children. A valid email address has been provided by the au pair. 22. Should a family need to replace an au pair for any reason whatsoever they will need to either purchase a new subscription or to reactivate their profile in order to make use of a subscription which still remains valid at that point in time. Payment of a subscription does not in any way guarantee that an au pair will be found through the site or that any au pair will remain with a family for any agreed period. Payment merely enables a family to contact potential au pairs through the site by giving them full access to the database. 23. Employment of an au pair, au pair plus or junior mothers help contacted through the AupairinBritain site is entirely at the family’s own risk. AupairinBritain cannot in any way be held responsible for the conduct or character of any au pair obtained through this website and shall not be liable under any circumstances for any loss, damage, expense, claim or injury, howsoever suffered. 24. It is to be noted that families must not employ au pairs, au pair pluses or junior mothers helps, obtained by using the services of AupairinBritain.com, to take sole charge of babies or children under the age of 3 years when there is not a parent at home full time or permanently working from home. It is permissible for them to take children under 3 to and from day care and to undertake limited babysitting duties. Families are further required to respect UK government recommendations on au pair working hours, duties and pocket money. 25. We will not be liable to the user for any breach of these Terms, which arises because of any circumstances that we cannot reasonably be expected to control, e.g. system break-down. 26. The user agrees that we may transfer the performance of any of our obligations or may assign these Terms or any of our rights or obligations totally or partly to a third party. 27. We make no warranty to replace any time-proportional repayment of the “Full Membership” fees in case of exceptional notice of termination of service unless at our sole discretion. AupairinBritain bears no obligation to monitor content for any purpose. All content provided by a user of this site is the sole responsibility of that user. AupairinBritain.com cannot in any way be held responsible for the accuracy or truthfulness of any of the information provided in any profile or testimonial and is not liable or responsible for any content. Any arrangements made between parties are solely at each party’s discretion, expense and risk. All express, implied and statutory warranties are expressly disclaimed.
